Setting up a Lasting Power of Attorney (LPA) is a smart step to protect your future or support a loved one. But how do you know if it’s officially registered and ready to use? This is a common question, especially during moments when legal clarity and authority are most needed.

What Does “Registered” Mean?
An LPA must be registered with the Office of the Public Guardian before it can be used. Until it’s registered, attorneys have no legal power to act on behalf of the donor (the person who made the LPA).
Once the OPG has reviewed and accepted the application, the LPA becomes legally active. You’ll receive official documents to confirm this.
How Do You Know If It’s Registered?
There are a few ways to find out:
1. Check the Physical LPA Document
If the LPA has been registered, the top of each page will be stamped or marked with the words: “Valid as a Deed – Registered”. You’ll also see a unique reference number and a date stamp from the OPG, usually on the front page.
If you’re holding a copy that doesn’t have these features, it might not be registered yet or you could be looking at an unverified copy.
2. Ask the Office of the Public Guardian
If you’re unsure or don’t have the document to hand, you can contact the OPG to confirm whether an LPA has been registered. You’ll need:
- The donor’s full name and date of birth
- The LPA reference number, if you have it
- Proof of your relationship to the donor or your authority to request this information
You can contact the OPG via phone, post or email. They may require you to provide identification or written permission.
What If It Hasn’t Been Registered Yet?
If the LPA hasn’t been registered, it needs to be submitted to the OPG. This can take around 8 to 12 weeks, depending on current processing times. You can register it at any time, even years after creating it, although earlier is always better to avoid delays when it’s urgently needed.
