What Does a UK Power of Attorney Cover?

In the UK, a Power of Attorney is a legal document that lets you appoint someone you trust to make decisions on your behalf if you become unable to do so. These decisions could be about your finances, your property, or your health and welfare.

If you’ve created a Lasting Power of Attorney (LPA) through a trusted service like Power of Attorney Online, that document is registered with the Office of the Public Guardian (OPG) in England and Wales. It’s official and legally recognised, but only in the UK.



Can a UK Power of Attorney Be Used Abroad?

This is where things get a little more complicated.

Generally speaking, a UK LPA is not automatically valid in another country. That’s because every country has its own laws and requirements when it comes to legal documents and decision-making authority.

That said, some countries may accept a UK POA if it’s been notarised and legalised (apostilled), essentially proving that the document is genuine and valid under UK law. Even then, the overseas institution or authority may still have the final say on whether they’ll accept it.

For example:

  • Malaysia, Spain, France, Australia, and the UAE may accept a UK POA for property or financial matters, if it’s properly notarised and legalised and sometimes translated.

  • Health and welfare decisions abroad are much trickier and generally require local documentation or legal authority in that country.

What If You Own Property or Have Family Overseas?

If you own a home or manage finances in another country, the most reliable option is often to create a Power of Attorney specifically for that country, through a lawyer based there. That way, you’re covered under local law and can avoid complications if your attorneys ever need to act on your behalf.

It’s perfectly legal to have a UK LPA for your affairs in the UK and a separate one in another country.
