When Does an LPA Become Active?

So when does an LPA become active? This is a fair question to ask after completing the paperwork for your LPA. People understandably assume that once everything is signed, attorneys can step in if they need to straight away. Registration with the Office of the Public Guardian is the crucial step that determines when an LPA can actually be used though.
Getting your head around how the registration process works can avoid confusion, rejected applications and difficult conversations with banks, care providers and medical professionals if you try to use an LPA too early.
When does a Lasting Power of Attorney actually become valid?
A Lasting Power of Attorney is only legal once it has been registered with the OPG. Until that registration is complete, the document has no proper legal authority, even if every section has been filled in correctly and signed in the right order.
Your attorneys can’t make decisions, access accounts or speak to organisations until the registration process has finished and the LPA has been stamped at the OPG.
Are there any exceptions that mean you can use an LPA before registration?
Unfortunately, no, an unregistered LPA can’t be used. Even if it’s urgent, the likes of banks, local authorities and the NHS are legally required to see a registered LPA before accepting ay instructions from an attorney.
This is another reason why registering as early as possible is very sensible. Waiting until a crisis means you need to expect a delay, as the registration process typically takes around 10 weeks.
What does the Office of the Public Guardian actually check?
During registration, the Office of the Public Guardian doesn’t typically assess whether the donor made the right choices. Their focus is on whether the LPA meets strict legal requirements.
- All the required sections are complete.
- The donor signed first, followed by the certificate provider and then the attorneys.
- No one is acting in a role they are legally excluded from.
- Dates, signatures and formatting are reviewed to ensure nothing is missing or done out of sequence.
Small errors, such as a missing middle name or an incorrect witness, can result in rejection or requests for correction.
Is it in the OPGs remit to check mental capacity?
The OPG doesn’t carry out medical assessments. They rely on the certificate provider’s declaration that the donor understood the LPA and was not under pressure when signing it. If concerns are raised at that point, the OPG may make further enquiries, but it’s not part of the routine registration.
How long does registration usually take?
Registration typically takes around 10 weeks, depending on demand and whether there are any issues with the application. Errors or missing information can add significant delays, which is why accuracy really matters from the start.
