How many types of Power of Attorney exist in the UK?

In England and Wales, the main options are:

  • LPA for Property and Financial Affairs
  • LPA for Health and Welfare
  • General Power of Attorney
  • An older version called an Enduring Power of Attorney (which is no longer available but may still be valid if made before October 2007).

Each serves a different purpose.

Do we recommend a particular one for most people?

For most people, either or both of the Lasting Power of Attorneys are what we’d typically recommend. The primary reason is they’re specifically designed for someone who has lost mental capacity.

Why do we recommend a normal LPA over a General Power of Attorney?

This is very simple: a General Power of Attorney is only valid while you still have mental capacity and is typically used for short term situations, such as a temporary illness. The main downside is it automatically ends if you lose capacity. However, a Lasting Power of Attorney continues to be valid after any loss of capacity, which makes it far more suitable for any long term needs.

Do I actually need both of the Lasting Power of Attorney documents you mention?

It’s generally a good idea to get both at the same time, so you can manage everything from bank accounts to medical treatment, if it comes to it. Having both gives you the comprehensive protection you’d need across all aspects of your life if the worst were to come to pass.

Is there a moment when a Lasting Power of Attorney is particularly important?

Taking from my own experience, it’s crucial for anyone with a family history of dementia or serious illness, so you can reduce the burden on your loved ones if your own health goes the same way. It’s also really useful if you own property, have savings or investments, or have specific wishes about your medical care and living arrangements.

What does it mean if I already have an Enduring Power of Attorney?

If you created an Enduring Power of Attorney before October 2007, it may still be valid, but only for the financial decisions it’s meant for.
